CartoMax TCG — Terms of Service

Welcome to CartoMax TCG. These Terms of Service (“Terms”) govern your access to and use of the CartoMax TCG website and your purchase of products or services from us.

By accessing our website, placing an order, or purchasing a product from CartoMax TCG, you agree to these Terms, subject to any rights provided to you under applicable law.

1. Online Store Terms

You must be legally capable of entering into a purchase agreement in your jurisdiction or have the authorization of a parent or legal guardian where required.

You may not use our products, website, or services for unlawful or unauthorized purposes.

You may not attempt to interfere with, damage, circumvent, or compromise the security or operation of our website.

2. Products and Product Information

CartoMax TCG sells products that may include:

• Trading cards and sealed TCG products
• Pokémon and other collectible products
• Booster packs, booster boxes, tins, collection boxes and related merchandise
• Japanese and imported products
• Limited-release or special-edition products
• Trading-card vending machines and related equipment

We make reasonable efforts to accurately display product descriptions, photographs, specifications and other information.

Product packaging, colors, promotional materials and manufacturer designs may occasionally differ from photographs shown on the website.

3. Trading Cards and Randomized Products

Trading card products may contain randomized contents.

Purchasing a sealed product does not guarantee any particular card, rarity, monetary value, pull rate or grading result.

CartoMax TCG does not guarantee that cards obtained from sealed products will receive any particular grade from PSA, Beckett, CGC or another grading company.

Market prices for collectible products can fluctuate significantly. CartoMax TCG does not guarantee the future market value or resale value of any product.

4. Product Condition

Unless otherwise stated in the product listing, products are sold according to the condition described on their respective product pages.

Sealed collectible products may occasionally have minor manufacturing, packaging, distribution or shipping imperfections, including small dents, scratches, corner wear, wrapping variations or other minor cosmetic imperfections.

A sealed product is not automatically represented as being in perfect or collector-grade packaging condition unless specifically stated.

5. Pricing

Prices are displayed in the currency indicated on the website.

We reserve the right to change product prices at any time before an order is completed.

Applicable taxes, shipping charges, duties, customs charges or other costs will be displayed or handled as required based on the transaction and destination.

A pricing or listing error does not necessarily obligate CartoMax TCG to fulfill an order at an obviously erroneous price, subject to applicable law.

6. Orders

Submitting an order does not necessarily mean that the order has been accepted.

Orders may be subject to inventory availability, payment authorization, fraud screening and other reasonable verification procedures.

Where permitted by law, CartoMax TCG may refuse or cancel an order in circumstances such as suspected fraud, payment failure, inventory errors, obvious pricing errors or attempts to circumvent product-purchase limits.

If CartoMax TCG cancels an order after payment has been collected, the applicable amount will be refunded unless another remedy is required by law.

7. Product Purchase Limits

Certain high-demand, limited-edition or special-release products may have purchase limits.

CartoMax TCG may reasonably enforce these limits to help prevent circumvention through multiple orders or accounts, subject to applicable law.

8. Payment

Payment must be made using a payment method accepted through our checkout.

Customers are responsible for providing accurate billing, shipping and payment information.

Payment processing may be provided by third-party payment processors. CartoMax TCG does not directly control the operation or security practices of independent payment processors.

9. Shipping and Delivery

Shipping times displayed on the website are estimates unless expressly stated otherwise.

Delivery times can be affected by carriers, weather, customs, holidays, destination, product availability and circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address.

Our separate Shipping & Delivery Policy may contain additional information applicable to an order.

10. International Orders

International customers may be responsible for customs duties, import taxes, brokerage charges or other fees imposed by their jurisdiction unless the checkout or product listing expressly states otherwise.

Customers are responsible for ensuring that products they order may legally be imported into their destination country.

11. Returns, Refunds and Final-Sale Products

Due to the collectible and market-sensitive nature of trading card products, products may be designated final sale, particularly where change-of-mind returns are concerned.

Opened or tampered-with randomized trading card products generally cannot be returned for change-of-mind reasons.

Nothing in these Terms or our Return & Refund Policy is intended to remove or restrict consumer rights that cannot legally be excluded or waived.

12. Damaged, Incorrect or Missing Products

Customers who receive an incorrect product, materially damaged product or an order with missing items should contact CartoMax TCG as soon as reasonably possible.

We may request photographs of the item, packaging, shipping label and shipping container to investigate the issue.

Where required, CartoMax TCG will provide remedies in accordance with applicable law.

13. Pre-Orders

Products identified as pre-orders are expected to ship after inventory becomes available.

Release dates and estimated arrival dates can change due to manufacturers, distributors, carriers or other circumstances.

Any special cancellation, payment or fulfillment conditions applicable to a pre-order should be disclosed on the applicable product page and will remain subject to applicable consumer-protection law.

14. Vending Machines

Where CartoMax TCG sells vending machines, the applicable product listing, quotation, invoice or purchase agreement may specify additional terms concerning:

• Machine specifications
• Voltage requirements
• Payment systems
• Custom graphics
• Manufacturing
• Shipping and delivery
• Installation
• Warranty
• Replacement components
• Commercial use

Customers are responsible for confirming their required voltage, electrical standards, installation requirements and applicable local regulations before ordering.

Where specific vending-machine terms conflict with these general Terms, the more specific written terms associated with the vending-machine transaction will apply, to the extent permitted by law.

15. Intellectual Property

The CartoMax name, CartoMax TCG branding, original website content, graphics and other original materials belonging to CartoMax TCG may not be copied, reproduced, distributed or commercially exploited without authorization, except where permitted by law.

Third-party trademarks, characters, artwork and product names displayed in connection with products remain the property of their respective owners.

The sale of third-party products by CartoMax TCG does not imply ownership of those third-party intellectual-property rights.

16. User Content and Reviews

If customers are permitted to submit reviews, photographs, comments or other content, they must not submit unlawful, fraudulent, defamatory, abusive, infringing or malicious material.

By submitting content for publication on our website, you grant CartoMax TCG the permissions reasonably necessary to display that content in connection with the website and our business, subject to applicable law and our Privacy Policy.

17. Prohibited Uses

You may not use the website to commit fraud, distribute malicious software, scrape or interfere with the website in an unauthorized manner, impersonate another person, violate intellectual-property rights, circumvent purchase restrictions, or engage in conduct prohibited by applicable law.

18. Third-Party Services

Our website may use or link to third-party services such as payment processors, shipping carriers, Shopify applications or external websites.

Those services may be governed by their own terms and privacy policies.

CartoMax TCG is not responsible for independent third-party services except to the extent responsibility cannot legally be excluded.

19. Privacy

Personal information is handled according to our Privacy Policy and applicable privacy laws.

Customers should review the Privacy Policy to understand how personal information is collected, used and protected.

20. Disclaimer and Limitation of Liability

To the extent permitted by applicable law, CartoMax TCG is not responsible for indirect or consequential losses arising solely from circumstances outside our reasonable control.

However, nothing in these Terms excludes, restricts or limits liability, warranties, guarantees or consumer rights that cannot legally be excluded, restricted or waived.

21. Changes to These Terms

CartoMax TCG may update these Terms from time to time.

The current version will be made available on the website with its effective or last-updated date.

Changes will apply prospectively as permitted by applicable law and will not improperly remove rights associated with previously completed transactions.

22. Governing Law

These Terms are governed by the laws applicable in the Province of Québec and the federal laws of Canada applicable therein, subject to mandatory consumer-protection rules and any jurisdictional rights that applicable law grants to customers.

Nothing in this section requires a consumer to waive a jurisdiction or remedy that cannot legally be waived.

23. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

24. Entire Agreement

These Terms, together with applicable policies, product descriptions and transaction-specific terms, constitute the agreement governing use of the CartoMax TCG website and purchases from us, subject to applicable law.
